Eve.Trade taking this account back, regardless whether it was locked or banned is irrelevant, the account is not yours so you have no right to resell it or recover it to keep for yourself. If you DO recover it you HAVE to give it back to your customer.

You will have 24 hrs to return the account to Dr.Aven or you will be banned.

Eve.Trades is arguing that since the account was banned, in essence lost, and because you agreed to a "Do not resell" clause, which you broke, he is allowed to recover the account. Below is my reply.

Let me ask you this. Did you sell the account? Yes. So at that point the account is not yours. You have no right to it under any circumstances. It doesn't matter if the account is locked, banned, or resold 100 times over, you cannot take the account back, that is theft.

I already read the LoL support tickets and saw he lost the account, swore at Riot support and couldn't recover it, but that is irrelevant. The account is not yours and you have no right to recover and resell it.

Your terms that stated "Do not resell it" only protect you from having to refund or provide compensation to the buyer. He broke the agreed upon terms so you are not obligated to refund the buyer or provide them with another account. However that does not mean you get to recover the account for yourself.

Since you did and the account does not belong to you, you must give it back to him.

What you should have done is made a deal with him about the account recovery when he contacted you. Since he broke the terms you are not obligated to help him, which would have given you leverage for getting a very good price for the account. This way it would have been legit.

My initial ruling stands. The account was sold by Eve.Trades and regardless of if it's banned or not, that does not give him the right to recover and resell it since he is no longer the owner of the account. He should have either made a deal with you or left it banned.

Eve.Trades must return the account to Dr.Aven.

Eve.Trades messaged me saying he will return the account back to you banned.

Since you broke the agreed upon terms and got the account banned yourself, with no fault to Eve.Trades, returning the account to you in the same condition it was in is an acceptable solution to this dispute. However maybe you guys can work something out where he returns the account to you unbanned.
