Question about "legal fraud"

Ok so theres this guy who i "sold" my account to, only for like 2 days before i took it back, telling him i was going to give him a full refund. Hes going nuts over it, claiming that it's HIS account even though none of the information was changed, nor was the email changed, literally nothing changed except the password. So there he is, freaking out that i took my account back, hes threatening legal action against me. Im like w.e ill pay you back then you don't get [censored] on me.

So a while goes by and i still havent paid him yet, so hes going on and on, i keep telling him imma pay him back (canadian paypal takes a while to transfer funds) Then he finally opens up a paypal dispute. I accept the dispute terms (full refund) and the dispute is closed. Im thinking, it's done.

Then a little while goes by, hes asking where his money is. I tell him that I transferred the money from my bank directly to your account which takes longer. Hes still freaking out. Once again claiming that I "stole" "his" account from him, the one he bought illegally anyways.

Now hes telling me that hes going to contact my local police and charge me with [censored]. So i mock his conversation with them, "so yeah...this guy took back his account that i bought illegally...yeah...yeah...yea he gave me a full refund...yeah"

So, does he have anything on me?

I know that it was a dumb move by me...the post he replied to was like a week old and wasn't bumped and [censored], not only that he didn't have a MD account and personally i felt like playing again...i know i know its dumb.

But once again, even though the information was ALL mine and [censored], he got a full refund...he can still press charges?

Taking an account back because you have buyers remorse is definitely poor business practice

nervecell123, it seems like you are confused on the matter of account trading. It does break Blizzard's EULA but it is NOT illegal...

I don't understand why people believe that just because Blizzard can terminate their services with you if you trade your account, that it also somehow makes it an illegal practice.

Basically if I was to provide you a service like, lets say mowing your lawn weekly and have you sign a year long contract where I would come out each week and mow your lawn. If it is in that contract that if you use any type of lets say plant feed / miracle grow outside of what I am using on the lawn and I find out through the extensive damage it would cause, then I could terminate my contract with you and not be obligated to fulfill the rest of that year's contract duration.

Would the fact that you put your own type of miracle grow on your lawn be illegal? No not at all... Would it be a cause to terminate the contract between you and I for the one year worth of services that I agreed to provide? YES it would.

This is how Blizzard's EULA works in this regard, but it DOES NOT make account trading illegal. It just means that if you were pissed at Blizzard for banning your account and tried to sue them over it, due to the clause in their EULA that stated "Account Trading is Prohibited" you would lose your lawsuit against them. THAT IS ALL... EULA is a CYA (Cover Your A(you know what) agreement which allows them to punish you through their means and not take legal repercussion from it.

Blizzard doesn't write the laws but they know how to protect themselves from legal recourse.

Here is what I can say now that we have this out of the way. If you HAVE refunded him and can prove it, the worse he could do is take you to small claims court over the ordeal. You AGREED to sell him the account and once the transaction is completed it is a LEGAL done deal. In other words the account is his and it is up to HIM to give it back to you if YOU want it back. It is no longer up to you, so you could lose the account to him in a legal battle (of course money would be re-exchanged for the item)..

I don't know if a court would wish to handle this but he could actually report you to your local police and it could be noted on record.

One last analogy, if you sell someone a stereo and then three days later you decide that you want it back since you missed having it around. The person you sold it to would have to sell it back to you at their own digression and they could charge you MORE than what they paid you since the item is now LEGALLY THEIR's... If you were to go to their house take it back and leave the money that they paid on their doorstep you know what this would be called? STEALING...

Who knows if the cops will go the extra mile to hold this against you or not BUT I will say that what you have done is inappropriate at the least and I would never consider dealing with you.

Ok, well here's my 2 cents.

First, don't use the fact that he didn't have an MD account against him - you shouldn't have dealed with him in the first place.

Second, if I was the customer, and the deal was completed, I'd be pissed if you decided to take the account back. As said in above posts, that's really awful trading manners. It also seems as if you waited a really long time to refund him - trust me, anyone in this situation would badger you.

If you have any hesitations about selling an account, then don't do it! It's that easy.

Number 1 Your a [censored]!!

Number 2 had a simlar situation where me and another person traded accounts and we stayed friends we even raided together but I soon enough got my epic flying mount and some t6 from the greens I recieved him, And the guy had started kara and low end raids and got a buyers remorse and hacked it back by sending his I.D. into blizzard, I relized what happened when tried to email recovery and his email worked for it, so send my id in got my toon moved him to another account and reported the other players account to have been bought by me and that it was unabled to be played on (think what you will what I did I tried reasoning with him) Long and short I lost all those hours of play time almost the whole burning crusade exp.---So i see where that guy is coming from even if was not as many hours but those are hours that he spent having fun on what have should been his account forever and you had no right to take that away from him without consaulting him first

ok heres an answer to the question the asked. yes he does have legal action over you if he had his credit card on that account after it was recalled thats first degree credit fraud and he can fine you double what you took back (first degree credit fraud also carries up to 5 years in prison depending on what you get charged with) i reccomend making good with this kid because if he was smart you could be in some serious trouble

99.9% sure he won't do anything. It's most likely a scare tactic. Everyone does it and it looks like it worked, why? Look at yourself, seems you are sketchin' out.

So to answer your question directly, yes; he potentially "could" do something. But I highly doubt that he will.
