Getting scammed.... guy keeps retaking account.. help?

I recently bought an account from someone for a pretty substantial sum of money (well over 1k..). It wasn't through this site btw. The transaction was done via western union.

I had talked with the guy for about a week and a half through emails, on the phone, etc.. just making sure we both felt secure in the transaction. I have ALL of his personal info and he has all of mine. Well the deal went through smoothly, I paid him and he handed over all the account info including secret question and everything.

All was well for about a week, then he called into blizzard and reclaimed the account. This infuriated me, I talked to him and he swore it wasn't him (obvious lie).. but I called and retook the account since I have all the info. Another 2 weeks go by and he does it again.. I took it back. This process has happened 3 times. I think he is trying to retake the account and xfer the main toon to a new account in his name.

If he leaves me with nothing.. what can I do? Are there any legal rights I have as far as sueing him for fraud or something? And could I also email all these correspondences to blizzard and get the accounts/toon banned?
 
I just want the account... but if he's going to try and screw me over like this after he has all the money.. I'm gonna do whatever I can to screw him over. What can I do?
 
I'd Transfer the toon to a new account with the same name, then flag the original account by follow a guide that zerotolerance wrote.
 
Ok so... even if I transfer the toon to the new account.. if the original account gets banned, won't that flag the new account as well and they will most likely also ban that?

And what precedence is there for suing someone over something like this?

Suing someone over virtual goods is somewhat of a lose/lose situation. There is an extremely slim chance you will win you settlement, and you will end up paying more than you payed for the account in legal fees.

Atm, as previously stated I would transfer the character off of the account as soon as possible. Making sure to not hit any flags in the process (this can be done by following the many guides on these forums, like the aforementioned guide created by zerotoleranceftw) Once the character is on the new account call blizzard to recall the original account (the one you have just transfered off of) twice in a short timespan and they will lock the account. This will NOT affect your new account as it is not a ban, simply a lock.

In order for the person you obtained the account from to take your account they would have to first call blizzard, only to learn that their account has been locked. Assuming they are the OO they will have to fill out an account retrieval form, and fax that to blizzard. Once blizzard gets back to them they will find out that the character has been transfered off of the account, and if they are smart enough, will fill out a "unauthorized transfer form". At which time blizzard will look into the details of the transaction and find that no red flags were raised during this transaction, and they will either take the users word for it, or deny him access to the character. <span style="text-decoration: underline">There is still a chance that after all of this he still can get the character back, the only thing you can do is make it 5x harder for him.</span>

Getting the character banned is a possibility whilst it is in his possesion, although I would recommend this as a LAST resort, only done once you have tried the above methods.

With trading, you cant do anything.

But because this involves money, it has gone from scamming to internet fraud. You can get him into legal trouble for this.
