I have 2 account but they both dont have the same names if i xfer one character over to one account so im using one account will it get banned?

Well, in order to transfer in the first place the last names on the battle.net or WoW account (depending if your account is linked or not) have too match.. if they do already have the same last names and you transfer there shouldn't be any problems.
