Just a little warning, this thread is LONG. Bare with it as I'm posting all information I have available to me in order to provide the best insight into our unique situation. Johnboyy805 does get belligerent and pissed when I talk to him so there is a fair amount of cussing which I can't remove because these are in screenshot form, sorry about that.

What pretty much happened is that on February 21, 2011 I bought a shaman from johnboyy805. I paid $475.00 via PayPal and the transaction was fine. Over the duration of our correspondence, no mention of any warranty or disclaimer was made, and none was posted in his thread either. The account was secure for a little over 2 months. On April 18, 2011 I traded this shaman and a paladin of mine for xCommieKidx's rogue. The rogue is fine and I still have it in my possession. I decided to buy it from him because I missed playing it. I purchased the shaman for $325.00 over PayPal. I played that night until about 2:30 AM the next day, then went to bed. The next morning I check my inbox to find an email from Blizzard stating that my password has been changed, I go to login and alas... no dice. So I run the automated recovery. I used the CD keys as proof of ownership and they were accepted, but the email on the account was changed so the recovery system sent the email to whoever has the account atm.

I'm going to refrain from calling Blizzard about this until we figure out what's going on here because I don't want the account locked. Submitting the ID usually ends up in failure, I know from experience. I'm going to post both sale conversation and the trade conversation, it gets dry at times but I feel all of it is necessary. This is pretty clear cut to me. CommieKid was the person that last sold you the Shaman. CommieKid should retrieve the account back and give it to you. If he cannot, then he will be held liable.

Right, but I'd also like to figure out WHO did this before I start considering liability. Is there any possibility you could notify ekcho of this thread? I want to talk with him.

I have offered to do this Beast, but Tkmstr1009 (whom i have given my full contact info, to include phone) has declined me doing this until he can get to the bottom of it.
And i would tend to agree with you on this, but i had the account for about a week (which originally was given to me by Tkmstr1009 in trade for my rogue) seeing as he has the same capabilities i do, i would say im liable except if i had nothing to do with this it kinda screws me and i would feel as though ive been scammed hahahaha.

But i have offered assistance and as well offered him toons in exchange if we cannot get to the bottom of who lifted the shaman from his possession.

Unfortauntly this account has been tossed around to so many people that it will be hard to identify the person responsible, exspecailly if we have no way to contact the OO on this.


But if its found that i am liable i will do what i can to resolve this issue.

o ok im just suprised how/why it was recalled by oo as it has been safe for numerous months but I myself just got scammed by a well repped member from 08. Trusting people is getting harder and harder.

Well the bottom line is that it was likely recalled by OO so now someone has to figure where to go from here.

Well i assume they are going to say it will fall on me to reimburse or make this right, even though john sold you the account that was not secure in the first place, then you in turn traded me an insecure account then i in turn sold it back to you.

Their was no way to determine when in time exactly an account was secure or not. It becomes insecure the moment it's stolen or taken back by the OO in this case. The point is that everyone knows trading accounts is probably the least secure method of obtaining accounts and people should know they can and will be held liable in an account sale or trade. In this case it is a bit more unique in the fact that it may have been the OO who stole the account back after it was traded 2-3 times after he traded it (that we know of). Ultimately it will be the OO being banned if it is found to be he recalled the account and it will more then likely come down on you CommieKid who may have to reimburse Tkmstr. Although it's obvious it is not your fault because you obtained the account in what you believed was a legitimate transaction. But because the account was in your possession last and sold, you will be somewhat liable for reimbursement. I'm just giving you a heads up of how this will fall.

Of course none of this will happen if the OO just gives back the account if he did truely take it. But from his actions it does not seem he wants to do so.
 
I've still not heard anything from ekcho. I don't think he plans on responding, more than likely he knows he's going to be banned.

I have just made contact with Ekcho after leaving a voicemail for him. He claims it wasn't him and that he blocked commiekid86 a long time ago.

Me and Tk talk on a daily basis, and from what i understand he isnt as concerned with reimbursement as he is finding the person responsible

The OO has contacted me ViA AIM saying he never blocked me, not sure what to think as the AIM msgs say one thing, and he says another, so do i believe the programming of Aol IM thats programmed to say what is going on.... or do i believe what some dude says

There can't be 2 OOs. He's simply lying about it because he told John he was the OO when John bought it.

Well theirs no way to determine who is the OO unless you find the person that matches the name on the account. If you believe ecko was the OO then find somone who may have done business with him and ask if his names matches the one on the account(maybe through a paypal transaction or WU transaction or a facebook search). Their is not much as mods we can do to find the OO of an account.

Ekcho is a scammer, few months back i traded with him and he recalled the account on me, i never posted a scammer thread on him because i dealt with it myself, i charged back all the payments done on his account and left him accountless, he begged me to fix it and i never did, since he recalled back and such.

Do not trust him, and i'd suggest to ban him asap, he's nothing but an 18yo asian kid who lives in Australia "not being racist or anything here" ...

I have his RL info, everything on him " Name + Address + Phone number/s + Passport Copy" ... i told Tkmstr1009 that i will search for them and provide them to him, it might help him out a bit to recover what goods he lost in any way.


Again... ekcho is a scammer.

I would like to keep xCommieKidx out of this if everyone agrees. The shaman was basically traded in a circle and it has been proven xCommieKidx was not involved in the recall, so if we can keep this between Tkmstr1009, johnboyy805 and ekcho, that would simplify things.

Going on that, johnboyy805 can you provide any proof where ekcho said he was OO. If so, he will be banned.

The name of the Bnet matches his name. That's solid enough proof IMO.

Unfortunately I cannot as this time. After the password was changed it rendered me unable to get in and take a screenshot of the name on the account, so unfortunately I cannot provide any *proof* but he does contradict himself and johnboyy I believe has chat logs of him claiming to be OO.

However, I do remember the name. His name is Michael Busch. Also yes, I believe CommieKid doesn't need to be involved anymore.

I can get the screenshot of paypal transaction, however I have gotten a new computer since I made a transaction with him and all my chat logs have been wiped since then. And I cannot contact him as he refuses to respond.

Has anyone attempted to recover this account since someone took it?

If there no additional or proof, then aim_johnboyy805 you will be responsible for compensating Tkmstr1009 since you provided a guarantee in your thread.

1. You told John you were OO.

2. You told me, John, and Commie months later that you were NOT OO.

3. I haven't seen you on AIM since we talked almost 2 weeks ago, and AIM does tell you if a user is blocked. You blocked all 3 of us.

4. If you don't want a ban, give me the shaman back.

I think we're done here.

aim_johnboyy805 didnt say that, Cursed4Life did, and its irrelevant at this point.

From the chat log johnboyy posted, it shows you did say you were the OO, so as far as that argument goes, I consider it settled.

The account was taken by someone else, you stated you are not the OO, so there is a change that the real OO did recall it. aim_johnboyy805 can you try recalling the account and see what happens?

haha sure I'll try haha haven't called in to blizzard or made a request email in over a year haha so any tips? I remember there used to be certain things that always made your chances of getting it back greater. Also let me look for info on old comp as I said before got a new computer
 
Well judging from the chat me an ekcho had it's safe to say he's a real ******. He told all 3 of us he wasn't OO after stating to John that he was... shouldn't that make him liable by default? Honestly this is getting really frustrating as I'm in the hole for almost 1000 bucks because of this doucher. If John can get it back that's great then we can settle this, but then I'd need to find this new mystery person who ekcho now claims is the OO and I'm sure as hell not in the mood for an e-manhunt.

See what I'm getting at here? He can't keep his story straight and he was being defensive so I don't see why bother even letting him run scott free here. It's no coincidence this happened I tell ya that.

Also the reason Cursed4Life says that is entirely plausible. He told me that what you've done here is exactly what you did to him... told him you were OO, then changed your story later AFTER it's been recalled. Could it be that he ACTUALLY has your real info Sir Alfred? He's compiled quite the collection of info and I don't think he's aiming in the wrong direction with his claims...

Yes, ekcho will be liable for compensation if the account cannot be recovered. However since no one has tried to recover it, we should at least try that first. If it cannot, ekcho will be liable to johnyboyy and johnboyy will be liable to you.

johnyboyy please update once you have attempted to recover the account.
 
What if Ekcho isn't collectible for whatever reason or he decides to just take a ban, do we just forget about compensation then? I'd like to negotiate with both Ekcho and John at this point, but like I said, if he can get the account back that would be more than great, but if not, I wouldn't be surprised... when an account is taken back by OO it makes it EXTREMELY hard to recall it back. Personally I feel with the behavior Ekcho exhibited and his expressed distaste with our "situation", he doesn't deserve to stay on MMO. He's caused enough damage, and I have a gut feeling he's not going to feel obligated to compensate John in the least bit.

JM2C; sorry if I come off as being belligerent in any way, but I feel my actions are justified.

Hey, sorry was working all day, but I have checked my old computer and do not have all the info saved as far as I can tell. I will continue to look for it though.

If the account was recalled by the OO ... then there will be no need to get it back by any of you, it will be so easy for the OO to take it back again, have it locked, and he/she sending in a Notarized I.D form to unlock it, making it impossible to be re-called again for some long time.
