I got scammed, now what?

I got scammed out of my account and now I don't have it, happened about 2 days ago, is there anyway to recover it?

Yes, and have your account information available. They will reset the email and give you your account back after you answer a series of questions.

and I also have the scammer's AIM, but no picture, is there any way he can get banned from here?

1. Post AIM logs/MD user name/Other Proof in the Scammers forum, he may get banned and it will help others to not be scammed by him.
2. Call Blizzard at the previously mentioned phone number (no you can't email) it will be especially easy if you were the original owner of the account
3. Learn from this mistake, now (hopefully) you won't fall for this scam again
